A home of lawyer Carlsen Philip is to go on sale at a public auction tomorrow after Bermuda Savings and Loan foreclosed on the mortgage.

Seaside Heights, a 0.34 acre waterfront plot with a three bedroom cottage that is attached to another house in Valley Lane, Sandys, goes under the hammer at the property at 3 p.m.

According to an advert in yesterday?s , the sale arises out of a mortgage between Bermuda Savings and Loan and Carlsen Eugene Philip and Chrislyn Renee Philip.

Andrew Horsfield of Bermuda Provident Company, which is organising the sale, confirmed Bermuda Savings and Loan foreclosed the mortgage.

He said: ?We?ve previously had 40 or 50 people looking at the property but it has been frustrated a number of times by people not being able to look inside the house, but now we would like to get it sold.?

Carlsen Philip has been sued by a number of people in the past few years, according to the writ book at the Supreme Court Registry.

He was called to the Bar in 1993, but according to the Bermuda Bar Association website ? which was last updated on October 31 last year ? he is not listed as having a practising certificate for 2003 or 2004.

According to the writ book, in November 1998, a writ was issued by Gerald R.C. Pascoe against Mr. Philip for $25,000.

In February 2003, Roland Winslow Simmons Sr. issued a writ against Mr. Philip and the following month, Bank of Bermuda (formerly Bermuda Home Limited) sued Mr. Philip and Deborah Ismay Philip.

In April 2003, Bank of N.T. Butterfield and Son filed a writ against him, as did Space Limited in May of 2003.

Mr. Philip could not be contacted by yesterday. The number for his office in Melbourne House, Hamilton, was ringing out yesterday, and his home number was busy during numerous calls yesterday afternoon.

But his father, journalist and former Progressive Labour Party Senator Ira Philip, said: ?It is a family property which we are endeavouring to save.?
