Sexual relations between a former female Police officer and one of her superior officers were consensual, defence attorney Richard Hector tried to establish yesterday in sex assault case underway in Magistrates' Court.

A 44-year-old male Police officer - who cannot be named for legal reasons - is charged with sexually assaulting the woman on four occasions between June and November of 2000.

Three of the assaults are alleged to have occurred at the married Southampton man's home while the fourth is alleged to have occurred at the victim's home.

In her fourth day of testimony yesterday, the alleged victim faced intense questioning from Mr. Hector on cross-examination.

Mr. Hector challenged the alleged victim on the sequence of events in two of the alleged assaults - one in her home and one in the home of the accused attacker.

He suggested that during the assault in her own home, the woman - who was in good physical shape - should have been able to fight off her aggressor when her allegedly had her pinned against a kitchen counter.

"While this was going on your hands were free," Mr. Hector asked.

"To some degree, yes, sir," the alleged victim replied.

"You could have scratched his eyes out or punched him in the groin could you not," Mr. Hector continued.

"Your worship, I tried every effort to get him off of me," the alleged victim replied. "I was trying to push him off of me but due to his body weight on me I was restricted."

Mr. Hector also attempted to shake the victim on the timeline of the alleged assaults.

Mr. Hector suggested that on the same day of the alleged attack at the woman's home, the two Police officers returned to the house later in the day but not entered the home because the woman had left her keys at work.

Mr. Hector suggested the two tried to get into the house "to finish what had prematurely ended earlier in the day".

But the woman said the attack has happened on a different day and while her accused attacker had made advances in her yard, she decided not to go in the house although she had to use the washroom.

Mr. Hector also established that the alleged victim had been wearing the exact same outfit on two of the attacks - a long printed skirt, a maroon fitted top and a black teddy.

The woman had already testified that she wore the outfit during the attack which allegedly took place in her home.

Mr. Hector then established she was wearing the same thing during an attack at the man's home after the man allegedly asked her to look at his computer mouse.

The woman claims when she went in his home, he forced himself on her and performed oral sex on her twice. She also claims he had sex with her and when he took out his penis he was already wearing a condom.

Mr. Hector took the victim through explicit, step-by-step descriptions of how the same events might have occurred through mutual consent but she consistently denied that this was the case.

However, she admitted that she continued to work with the male officer and exercise with him after the assaults had taken place.

And she admitted that when she was training for a fitness competition, she admitted she asked him to feel her biceps and posed for him despite the assaults.

Mr. Hector also tried to establish that the two officers had spent time together casually, but the alleged victim claimed any time she spent with the man was on working hours.

And he suggested the activity the which the woman claims took place during the attacks would be physically impossible if the man was restraining her.

The trial continues tomorrow in Magistrates' Court before Acting Senior Magistrate Carlisle Greaves.
