Pembroke man denies trying to cause harm to another man

A 26-year-old appeared in Magistrates? Court yesterday to face an indictable charge.

Antoine Herbert Anderson, of Government Gate, Pembroke, was charged with intent to burn, maim, disfigure, or cause grievous bodily harm to Dwayne Trott.

The incident took place on January 4, 2001. Crown counsel Anthony Blackman had no objection to bail.

Larry Mussenden appeared for Anderson. Acting Senior Magistrate Carlisle Greaves set bail at $1,000 with a surety.

Anderson is to appear in Magistrates? Court again for mention on December 24.

Homeless man promises fight for fingerprints

A homeless man accused of stealing hair accessories and a vacuum cleaner was remanded in custody in Magistrates? Court on Monday.

Donovan Nesbitt, 41, of no fixed abode, pleaded not guilty to stealing hair accessories and damaging a car door when he allegedly stole the products between July 15 and 16.

In a second charge he pleaded not guilty to stealing a Victory vacuum cleaner and a gold chain on October 7.

Acting Senior Magistrate Carlisle Greaves ordered Nesbitt to allow Police officers to take his fingerprints after Crown counsel Shakira Dill said there was forensic evidence linking the defendant to the crime scenes.

But Nesbitt said: ?They ain?t getting no prints off me. It will have to be a fight. I won?t tell you (Mr. Greaves) what I feel about you.?

Mr. Greaves said: ?I still eat, I still drink and I still make love, your feelings are of no consequence to me.?

Mr. Greaves remanded him in custody for two separate trial dates.

For the hair accessories he will be tried on January 13 and for the stolen vacuum cleaner he will go to court on February 19.

Probation reports demanded for crack addict

A man who stole liquor and cigarettes and sold it for crack cocaine was remanded in custody in Supreme Court yesterday until reports are finished.

A list of 11 counts of breaking and entering that occurred between July and September were read in court during sentencing proceedings.

Craig Wilhelm Stapff, 40, pleaded guilty to breaking into numerous social clubs and the A-1 Paget Market and stealing $3,650.80 worth of liquor, cigarettes and gaming machine money. He admitted, upon his arrest on October 3, that he had sold the alcohol and cigarettes on Court Street and used the money to buy crack cocaine.

Defence lawyer Mark Pettingill said the man ?wanted earnestly to have help? and said, to his knowledge, no reports had been ordered although he felt they were necessary for sentencing.

Assistant Justice Archibald Warner agreed and said: ?I cannot decide on sentencing without those reports.?

He added that if the defendant had requested reports during the arraignment session then he should have been granted them.

Mr. Pettingill requested a pre-sentencing report, a social inquiry report and a Bermuda Assessment Referral Clinic (BARC) report.

Stapff was remanded in custody until the arraignment session in February.

Career criminal locked up for Christmas

A man?s plea to Acting Senior Magistrate Carlisle Greaves to keep him out of prison for Christmas fell on deaf ears on Monday.

Charles Howard Eugene Ebbin 45, of Friswell?s Hill, Pembroke, pleaded guilty to breaking into an office at King Edward VII Memorial Hospital on November 22 and 23, but he denied being in possession of a screwdriver and gloves.

Crown counsel Shakira Dill said Ebbin was caught by a hospital employee who noticed the door to her office was slightly ajar. She then confronted Ebbin and asked him how he gained entrance to her office.

When he was arrested he told Police that he had earlier been with a friend, used some cocaine and tried to get more when he returned home.

Ms Dill told the court that he had several previous convictions of a similar nature.

Ebbin asked Mr. Greaves for a social inquiry report and said that he had been receiving drug treatment, although he did not indicate where he was receiving it.

?I have never made it so far,? Ebbin said. ?Can I have probation or a social inquiry report? I will not let the courts down ? I will be law abiding at this time.?

Mr. Greaves said: ?You have the most breaking and entering convictions in Bermuda and the Caribbean. The most I have ever seen.?

He then sentenced Ebbin to 12 months in jail ?because that is the maximum they allow me?.

Police found cannabis, cocaine after search

Armed with a search warrant, Police found 1.77 grams of cannabis and 2.86 grams of cocaine in a King?s Gate, Pembroke home on August 29, Magistrates? Court heard on Tuesday.

Kemo Simmons, 24, pleaded guilty to possession of cocaine and cannabis. Simmons told the court: ?I am sorry for wasting the court?s time.?

Acting Senior Magistrate Carlisle Greaves fined Simmons $750 for the cannabis and $1,000 for the cocaine.

St. David?s man denies drug charge

A 22-year-old man pleaded not guilty to drug and paraphernalia possession in Magistrates? Court on Tuesday.

Gregory Outerbridge II, of Jacobs Point Drive, St. David?s was charged with possession of cannabis in an increased penalty zone near St. David?s Primary School on May 23.

On the same day he was charged with possession of resin from cannabis and possession of cocaine.

On May 24 Outerbridge was charged with possession of a razor blade and clip board intended for drug use.

Acting Senior Magistrate Carlisle Greaves set bail at $5,000 with a surety. A trial date was set for January 30.
