Ex-girlfriend ?called rape?, says sex assault accused
A 22-year old Smith?s Parish man charged with sexual assault yesterday maintained that his former girlfriend invited him to her house and said she never called out someone else?s name during sexual intercourse.
The man, who is representing himself, was giving evidence after his ex-girlfriend claimed earlier in the trial that she had been expecting ?company? on the morning of February 19 and had awakened to find someone performing oral sex on her and assumed it was her intended guest.
The complainant had said she called out someone else?s name and did not realise it was her ex-boyfriend until he entered her from behind with out a condom. She said she realised something was amiss because her intended guest always wore a condom.
Yesterday, the 22-year-old claimed the complainant was lying and that she knew it was him because they had sexual intercourse against a wall before he placed her on the bed and told her to turn over.
While on the witness stand, the defendant said the woman never kicked him or threw him out of bed and denied that she ever cried or asked him how he could do something like this.
He said he got dressed and left the complainant?s house 30 minutes after he arrived and told the woman he had to return to his girlfriend. He told the court the woman was annoyed but followed him out and locked her front door behind him.
He alleged that she knew fully well it was him having sexual intercourse with her and that she consented. He said she ?called rape? because her boyfriend had seen his car at her driveway and questioned her about it.
The defendant claimed that his ex-girlfriend invited him to her house while they were both at Club Malabar. The complainant and her daughter, who was also at the club, deny seeing the defendant or speaking to him.
The defendant told the court he has been in trouble with the law before and had never turned himself in.
?If I was guilty, I would not turn myself in,? he said. ?I would run until they caught me. That?s what I?ve done before.?
The case continues on December 12.
