Man to face jury trial for perjury
A 27-year-old Pembroke man who appeared in Magistrates? Court last week to face the charge of giving false testimony will have the matter sent to the Supreme Court for trial.
Antoine Anderson, of St. Monica?s Lane Pembroke, was charged with giving false testimony in the Wellington Oval trial which he did not believe to be true, touching a matter which was material to a question in the proceedings, namely the identification of the defendants.
However, Magistrate Ed King said the offence was an indictable offence meaning it was serious enough to be sent to the high court for trial.
Anderson was not required to plead to the charges.
Mr. King said the Criminal Code does not give a Magistrate the power to impose a penalty of five years.
?A Magistrate has no jurisdiction in this matter,? said Mr. King.
Crown counsel Shakira Dill is prosecuting the case.
Lawyer Mark Pettingill will represent Anderson.
A trial date will be set in the new year.
