Developer Gilbert Lopes has been denied permission to build a 54-unit condo development on Cedar Avenue.

The development with ground floor commercial space was to be located on 31 Cedar Avenue, the site of the former English Speaking Union property.

The plan did not meet the requirements of the City of Hamilton Plan, the Development Applications Board said in its refusal notice.

The fifth, sixth and seventh storeys of the development did not meet the upper storey setback requirement as required by a policy in the Hamilton City Plan. The seventh and eight storeys are also contrary to one of the policies of the city plan.

The proposal, submitted on May 18, did not provide a traffic impact study or environmental impact statement. One of the designated parking spaces for the handicapped also did not comply with the Hamilton City Plan as it was not of sufficient size.

The public art component did not meet the intent of a policy in the plan in addition to ramps into the parking areas. Mr. Lopes had planned to build units, from studios to two-bedrooms plus dens. Work was scheduled to begin later this year. Mr. Lopes is also the man behind the 17-unit residential building at 10 Dundonald Street, next to the Olympic Club.

Mr. Lopes said he would appeal the decision.

Housing development gets green light

Plans for a residential housing development in Southampton have been approved by the Development Applications Board.

The development, located on Lot C off Whale Bay Road in Southampton, proposes six units with a swimming pool and gazebo.

The development, received on April 24 and revised in June and July, must have a provision for storm water run-off and parking spaces for eight cars laid out in accordance with planning regulations. The site for the development must also be landscaped according to plans. A communal garbage storage area must be provided as a planning requirement. In order to protect the visual amenity of the neighbourhood there shall be no storage of excavated material on site. All excess materials must be removed from the area during the course of building operations.
