A Magistrate later this month will hear legal arguments from a defence lawyer representing a woman involved in the pedestrian crossing death of six-year-old Tyaisha Cox last summer.

Saul Froomkin, QC, represented Melanie Wedgwood, 29, of Hillview Road, Warwick who was charged yesterday with driving without due care and attention on August 7, of last year on St. Mary?s Road, Warwick. Wedgwood did not have to enter a plea yesterday.

Saying it was ?a simple matter? Mr. Froomkin said: ?A ticket has been issued for driving without due care and attention under the Traffic Offences Act. I know the Act states the basis for issue of traffic tickets are by way of a summons and that doesn?t include due care.?

Mr. Froomkin later said: ?It was basically a question of whether the charge can proceed under the Traffic (Offences) Procedure Act.?

Magistrate William Francis adjourned the matter for legal arguments, which will be heard on June 23.

Several members Tyaisha Cox?s family intently watched the hearing.
