Trespassers fell asleep after drink binge
Three young men from Cockburn Road in Sandys were given an absolute discharge in Magistrates? Court for trespassing on a Wedco property.
Davan Daniels, 20, Stefan Durrant, 17 and Joshua Wolffe, 20 were charged with trespassing on the Wedco property ?The Cottage? on July 15.
Crown counsel Shakira Dill said they were found at 6.55 a.m. sleeping in one of the bedrooms.
While Durrant and Wolffe pleaded guilty to the offence from the start, Daniels did not and returned to court to change his plea only after his two friends were given an absolute discharge.
Durrant told Magistrate Khamisi Tokunbo that they had gone fishing near the property and decided to got to the house and get drunk.
He said they fell asleep, but was adamant that he had not seen a ?no trespassing? sign.
Mr. Tokunbo told the youngsters they did not need convictions for this, but that they were ?acting stupid? and that they were even incapable of defending themselves in court.
He gave Durrant and Wolffe and absolute discharge and about a half an hour later, Daniels returned.
He stood grinning at Mr. Tokunbo for a while before saying that he wanted to change his plea to guilty.
He said a lawyer had told him to plead not guilty because he had not seen the signs on the property.
Mr. Tokunbo asked Daniels what he wanted the court to do now.
?Possibly you can take ... um, um ... you can ease me up like my friends?? Daniels asked.
He added that he had been drinking and fallen asleep while they waited for the fish to bite.
Mr. Tokunbo told him he was lucky he did not fall asleep next to the water, or he would have woken up amongst the fishes.
But he also gave the grinning Daniels an absolute discharge.
