A Pembroke man faces up to ten years in jail after a Supreme Court jury found him guilty of grievous bodily harm with intent on an off-duty prison officer.

Shannon O'Brien Tuzo, 30, of Marsh Lane, will appear before Assistant Justice Archibald Warner today for sentencing.

The jury was sent out at lunchtime yesterday but returned four hours later to seek clarification on the issue of "intent" in the charge of causing grievous bodily harm. Mr. Warner explained there was no textbook definition of intent and it was impossible to ever say what the intent of another person was. But he advised the jury to draw inferences and look at the circumstances of the case.

The jury returned shortly after and gave a unanimous verdict that Tuzo was guilty of the charge and had joined with others in the attack on Craig Randall Clarke, a 33-year-old Westgate corrections officer from Devonshire.

Mr. Clarke lost 70 percent of vision in one eye and needed stitches and work done to his nose after the attack outside Club 40 on Front Street in the early hours of January 1, 2002.

Shaki Eugene Crockwell, 21, of Happy Valley Road, Pembroke, has already admitted causing grievous bodily harm to Clarke and will be sentenced at a later date for the offence which carries a maximum five-year jail term.

On Tuesday Mr. Warner ordered the acquittal of a third man ? Raymond Winslow Burgess, 25 ? who had pleaded not guilty to causing grievous bodily harm with intent to Clarke.

Clarke had been out celebrating New Year's Eve at the Club 40 nightclub and offered condolences to Troy Rawlings over the recent death of his brother Steven (Pepe) Dill who died in prison just weeks before from a severe asthma attack. An inquest recently heard that he had died due to a lack of timely medical attention.

An argument ensued and two men began to beat up Clarke, said prosecutor Anthony Blackman. Tuzo got involved and overtook others to get to Clarke and landed two blows which floored him.
