A woman told a magistrate last week she grabbed her husband's privates and struggled with him to end an alleged sexual assault earlier this year.

The man - who cannot be named for legal reasons - denies committing a sexual assault. His trial before Magistrate Will Francis continues today.

The woman said he put his arms around her and kept saying "you are my wife", adding: "We struggled on the floor and then he put me on the bed."

She told of how the struggle continued and in her trying to escape his grasp and fighting with him.

Crown counsel Charmaine Smith asked what injuries she incurred and the woman said she had bruises on her legs, arms, wrists and bite marks on her shoulder and arm.

She explained: "I didn't want him sleeping with me because, I didn't know who he had been with."

The court heard that she finally got him off her by pushing him after he loosened his grip on an arm, adding: "I was already crying, but now I was crying uncontrollably and he eventually got off."

She told of how she went to the bathroom and tried to clean up her bruises. She said when she came out of the bathroom he was sleeping on the bed.

She said she rang her sister because her brother-in-law is a Police officer. Mrs. Smith asked: "After the conversation with your sister what did you do?"

"I got myself dressed and looked in his trousers were I found a pair of socks in his pocket. I then went outside to his bike where I found a letter from a woman under the seat. This confirmed my suspicions that he was not being truthful in the marriage."

The woman explained that this was not the same woman that she was accusing him of being with.

She said she went back into the house and woke him and confronted him about the letter until her mother arrived.

"What happened then?" asked Ms Smith. "I finished packing and my husband was saying, stop acting silly and unpack your clothes.

"My mother took me to the hospital and I was examined by a doctor. A Police officer visited me and I was later photographed."

The woman admitted that since the separation they have communicated by phone and in person, including one about loan payments. She also said the man had asked her to drop the charges.

She said she told him "I would not drop the charges as he had lied" and the charges were now in the hands of the Police and the Prosecution.

Defence lawyer Larry Scott asked the wife if that was the only altercation that she and her husband had, and suggested that they in fact had an argument on the front porch, but the woman denied this.

He suggested that during the altercation she had gripped a helmet and hit his client, spraining his finger, and she denied the suggestion and said he never got off the sofa when she was in the living room.

Mr. Scott then suggested that she was suspicious of her husband and asked her if she ever stayed out late. She said: "Not that late, (but) he came in at 6 a.m."

The case then broke for legal arguments.
