Magistrate tells man 'you need to check yourself'
A man who was released from jail just over two weeks ago received a trip back after assaulting Police officers.
Tracy Caines, of Cedar Park Road, Devonshire, originally pleaded not guilty to six offences but changed his pleas in Magistrates court yesterday.
The 32-year old defendant admitted to assaulting P.c. Webster, violently resisting arrest, causing wilful damage to a Police car, obstruction, and assaulting P.c. Trott on October 24.
He pleaded not guilty to one count of assaulting P.c. Trott but the crown offered no evidence.
The court heard from crown counsel Maria Sofianos that officers received a report of an assault in Hamilton Parish around 3.30 a.m. and saw the suspect walking along North Shore Road, by Dub City.
The officers approached the defendant who had a wound on his head and blood on his shirt, and asked his name.
Caines walked towards one of the officers and shoved him causing him an ankle injury.
He said: "I'm not saying anything to you. I don't even know what country you're from."
The officers informed the defendant he was under arrest for obstruction.
When he put his hands together to be handcuffed, he swung at one of the officers hitting him.
An officer pulled out pepper spray to try to subdue Caines, but he pulled one officer to the ground before they managed to get him inside of the Police car.
In the car, Caines laid on his back and kicked the rear glass windshield in and continued to kick and spit at the officers.
When he was finally subdued, he was taken to the King Edward Memorial Hospital for treatment.
Caines, who was released from Westgate Correctional Facility on October 13 for a similar offence, was represented by Larry Scott.
When asked if he had anything to say, the defendant said: "I apologise to the courts and the officers for spraining his ankle. I had just finished being robbed and attacked by a knife."
Caines explained he just wanted to press charges against the man who had robbed and assaulted him and was upset he was being arrested when he was a victim.
Magistrate Khamisi Tokunbo asked Caines: "You like Westgate? All I can do now is send you back up there. You need to check yourself."
Caines received three months for assaulting P.c. Webster, 30 days for violently resisting arrest, 30 days for causing $745 worth of damage to the Police car, three months for obstruction and six months for assaulting P.c. Trott causing an ankle injury.
