Magistrate Archibald Warner heard that Rego Sousa was followed by Police in a marked car as he drove a Hyundai car erratically on Front and Parliament streets at 2.15 a.m.

Crown counsel Veronica Daley told Mr. Warner officers, who stopped Rego Sousa, noted that his eyes were glazed, and he smelled strongly of intoxicants.

He told Police he had "a few beers and some rum'', but when he was arrested he said: "I would never drink and drive. I just lost two friends from drunk driving.'' When a Michael Steven Rego Sousa failed to show for a September court hearing, Police discovered the man arrested on August 21 was David Charles Rego Sousa.

"I'm guilty of the offence,'' Rego Sousa told Police once he was arrested. He had nothing to say before Mr. Warner.

Rego Sousa was also fined $100 for not having a cycle licence on that day. The fine must be paid by November 30 or he must spend 90 days in prison.
