Board's rejection of his proposal to build a three-story office building on land zoned commercial between Spurling Hill and Cavendish Road in Hamilton.

The 20,000-foot development, for Apsley Trust, was rejected by the Board on the grounds it exceeded the maximum height of three storeys above the level of a public road, that the "massing and design of the building is not compatible with the Bermuda image or the amenities of (this) area,'' and proposed access and parking will have a detrimental impact on the flow of traffic.

"That's their opinion; it's very subjective and I'm going to appeal,'' Mr.

West yesterday told The Royal Gazette . He refused further comment.

Architectural drawings however indicate the proposal's Spurling Hill facade will stand three storeys with penthouse dormers over the road way, a total of 34 feet. The Cavendish Road face will stand at half of that including the penthouse.

In other matters the DAB approved an application from Mrs. Carleen Griffiths of the Yellow Roses Rest Home at 11 Cove Valley, St. David's, for construction of retirement house suitable for seven occupants.

In January the rest home was hit with a $50,000 blaze which destroyed most of the lower floor of two-story house.

The Board resolved the new project should be subject to landscaping and provide parking for three cars.

The Board also approved an amendment to the dolphin habitat and ancillary marine components-alternative holding facility for Southampton Princess' Dolphin Quest.

Approval was granted on the condition the holding facility be used for temporary use in the event of emergency weather conditions.

The project received prior approval for the construction of a protective cove that would act as a nursery area for the dolphins.
