Mr. Donald, who stepped down as Police Commissioner last week, yesterday instructed his lawyer Mr. Saul Froomkin to sue the weekly newspaper.

The action stems from the Times' April 16 and May 1 issues which featured stories about $25,650 in cash missing from the Supreme Court.

Yesterday, Mr. Froomkin said he had been instructed by Mr. Donald to file suit at the Supreme Court. Under Bermuda law, libel actions are determined by a jury.
