Gun threat led to fight in bedroom
22-year-old Pembroke resident $500 in fines yesterday.
Vaughn Eric Joseph, of Deep Dale, pleaded guilty in Magistrates' Court to behaving in a threatening manner on May 2, entering his ex-girlfriend's St.
George's home without permission, wilfully and unlawfully damaging a glass pane and telephone, and unlawfully assaulting Ura Ible doing him bodily harm.
The court heard that Joseph visited his ex-girlfriend, Lynn Wales, shortly after midnight on May 2 and found Ible, her boyfriend, there.
An argument took place and Joseph threatened Ible with a beer bottle, Insp.
Peter Duffy, prosecuting, said.
Ible locked himself in a bedroom and Joseph tried to open it with a nine-inch knife.
Unsuccessful, he left the house and broke into the bedroom through a window.
Insp. Duffy said a fight between the two men ensued in which Ible received bites to his hand and a telephone was damaged.
Joseph left the house, but was later arrested and charged, he said.
"My ex-girlfriend knew what would happen if I came into contact with this guy because he had threatened me with a gun,'' said Joseph, who had no previous similar convictions.
He claimed Ible had told friends he was going to "get Joseph first.'' "When I got there Ible was drinking a Guinness and I took it from him,'' Joseph told Senior Magistrate the Wor. Will Francis. "But I did not intend to hit him.'' Joseph said it was Ible who threw the first blow in the bedroom. And he said he only broke into the room after he was locked out of the house and refused entry to retrieve his clothes.
"He threatened me,'' Joseph said. "You just gave him a fine of $500 for possessing a gun. He was carrying it like he's in the (United) States, like he's a marksman or something.
"I have three children to support, so I said I'll get him first and that's what I did.'' Joseph said his ex-girlfriend should not have let him in the house initially because she knew Ible was there and he (Ible) was threatening to kill him.
Mr. Francis said Joseph appeared to provoke the situation by forcing his way into the bedroom.
But Joseph insisted that he only did this as a last resort to retrieve his clothes.
Mr. Francis fined him $200 for behaving in a threatening manner and $100 for each of the other charges.
