Senior Magistrate Will Francis told Charles Wilmot that he considered the attack was part of a `domestic dispute'.

Wilmot, of Smith's Avenue, pleaded guilty to using threatening words and to unlawful assaulting Donna Smith and causing her bodily arm.

Police prosecutor Sgt. Anthony Mouchette said Wilmot approached Ms Smith as she was waiting for a bus at Middle Road, Warwick on January 28.

Wilmot told Ms Smith he had seen her with another man and said he was going to find the man and shoot them both.

Sgt. Mouchette said as Ms Smith was walking to her Khyber Heights, Warwick home on March 24, Wilmot approached her and began to shout at her and put his hands to her face.

When she did not pay attention to him, Wilmot grabbed an umbrella Ms Smith was carrying and hit her legs until the umbrella broke, Sgt. Mouchette added.

They began to struggle and during the struggle they both fell over a five foot wall.

But yesterday Wilmot's lawyer Myron Simmons pointed out that Wilmot had relations with Ms Smith and was the step-father of her three children.
