Prosecutor Sgt. Anthony Mouchette said Police went to Michael Nisbett's Bob's Valley Lane, Sandys Parish apartment at 6.25 a.m. on March 27.

The officers gained entry forcibly because Nisbett did not open the door when requested to do so.

Once inside, officers found five empty plant pots and a trail of soil leading to an upstairs apartment. After a thorough search Police found five freshly uprooted plants on top of a wall unit.

They also found seeds and plant growing mix near the front door and wet plant leaves in a Ziploc bag in the fridge.

Sen. Lawrence Scott, representing Nisbett, said: "My client wants to put this matter behind him. He apologises to the court for the inconvenience but the plants were for his own use.'' IMPAIRED RIDER FINED CTS Impaired rider fined David Guilfoyle left Magistrates' Court $450 poorer after he pleaded guilty to riding a motorcycle with more than twice the legal limit of alcohol in his blood.

Guilfoyle, 36, of Melville Road, Devonshire, admitted the August 21, 1997 offence.

Sgt. Anthony Mouchette, prosecuting, said Guilfoyle was riding east on Middle Road when he was spotted driving erratically.

When asked if he had been drinking Guilfoyle replied that he had two beers. A breath test revealed he had 197 milligrams of alcohol in 100 millilitres of blood. The legal limit is 80 milligrams in 100 millilitres of blood.

Senior Magistrate Will Francis also took Guilfoyle off the road for 12 months.

BREAK-IN FOILED CRM Break-in foiled Police are looking for a man who tried to break into the apartment of a Smith's Parish woman.

The woman said she was awakened around 4 a.m. yesterday by her pet rabbit "roaming around'' in an unusual manner.

She then heard someone outside her Manor House Drive porch, trying to open her door.

On investigating, she told Police, she saw a man standing on the porch.

She screamed but he remained there before jumping over the rail and hiding in her plants.

Police spokesperson Evelyn James Barnett said neighbours shouted to the man who jumped on a motorcycle parked in the driveway and left.

The would-be intruder was described as white, about five-feet, eight-inches tall, of solid/muscular build, weighing about 190 pounds and with a low hair cut.

He wore a light-coloured golf T-shirt and casual, light-coloured Bermuda shorts.

ALLEGED VANDAL HELD CRM Alleged vandal held A 14-year-old boy ended up in custody after he was seen damaging a jeep outside Hamilton Police Station.

Police said the offence was witnessed shortly after 9 p.m. on Wednesday.

"When spotted the boy ran, and was chased by Police, and caught on Reid Street,'' spokesperson Evelyn James Barnett added.

"He was conveyed to Hamilton Police Station, searched, interviewed and detained until the arrival of his mother.'' The boy was bailed and ordered to return to the Police station next month.

Police were also looking into vandalism at the Co-op Supermarket. Officers on patrol at Union Street, Pembroke early yesterday morning saw one of the store's front windows smashed.

CLASSROOM BURGLED CRM Classroom burgled Police are investigating the third act of vandalism at a school within a week.

Staff at Prospect Primary School in Devonshire reported that someone broke into a classroom on Tuesday evening.

When the teacher returned to school the next day she discovered a broken window and a Panasonic CD Walkman was missing from her desk.

But the incident followed break-ins at Francis Patton Primary School in Hamilton Parish and Clearwater Middle School in St. George's last weekend.
