Rudolph Ernest Smith, 26, of Perimeter Lane, committed the latest offence on May 4, prosecutor Sgt. Donald Grant told Magistrates' Court.

Police recognised him as a disqualified driver when they saw him on a blue Yamaha in Glebe Road, said Sgt. Grant.

Sgt. Grant explained Smith had previous convictions for the same offence, recently receiving a three-month jail sentence, suspended for two years.

Acting Magistrate the Wor. Arthur Hodgson told Smith he had no "discretion'', and had to activate the suspended sentence.

He gave Smith a further three-month sentence -- suspended for two years and to run concurrently -- and banned him from driving until May 1997.

Smith had told Mr. Hodgson that his job was "on the line''.

But Mr. Hodgson replied: "Your record is atrocious.'' WAITER DISQUALIFIED FOR DRUNK DRIVING CTS Waiter disqualified for drunk driving A cruise ship waiter who was so drunk he fell off his auxiliary cycle when he tried to make a U-turn on Front Street, was fined $450 and taken off the road for 12 months when he appeared in Magistrates' Court.

Kazium Akyuz, 25, admitted the offence which occurred on May 4.

Police Prosecutor Insp Peter Duffy said a Police patrol was traveling east along Front Street when they saw Akyuz riding a livery cycle with a pillion passenger.

The passenger was not wearing a proper helmet. At the junction with Court Street, Akyuz tried to make a U-turn and fell off the cycle.

When approached, officers found him to be unsteady on his feet and his breath smelled strongly of alcohol.

He was arrested and taken to the Hamilton Police Station where he failed the alco-analyser test with 160 milligrams of alcohol in 80 millilitres of blood.

Magistrate the Wor. Cheryl Ann Mapp fined Akyuz $450 for the offence and took him off the road for 12 months.

FINED $400 FOR STRIKING POLICE OFFICER CTS Fined $400 for striking Police officer A 34-year-old Warwick woman who struck a Police officer across her face and incurred a debt from a taxi driver using false pretences, was fined $400 in Magistrates' Court.

Debra Jean Richardson of Cobb's Hill, pleaded guilty to both offences that occurred on May 6, 1995.

Sgt. Donald Grant prosecuting, told the court a taxi driver picked Richardson up from Till's Hill in Pembroke.

She told him to take her to Cobb's Hill. Along the way Richardson asked the driver to buy her a beer and he asked her whether she could pay for the trip.

Richardson told him that she was meeting another person at her destination who would have the money.

Since there was no one there to meet her, the driver refused to let her get out of the taxi and drove to the Hamilton Police Station.

There, Richardson initially made a false accusation of sexual assault against the driver but she later recanted.

While in custody she became agitated and struck a W.p.c. Fawn Wade on the side of her face.

Duty counsel Ms Patricia Harvey told the court that Richardson became irate when she was accused of stealing from the taxi driver because that was not her intention.

Furthermore Ms Harvey said Richardson was under the influence of alcohol at the time which motivated her violent behaviour.

Senior Magistrate the Wor. Will Francis said: "I accept your explanation but taxi drivers serve us all. They have to be protected because their work makes them vulnerable.'' He then fined Richardson $200 for the assault and $200 for defrauding the taxi driver. He ordered $11.87 of that fine to be paid to the driver as compensation.

SOCIAL INQUIRY REPORT ORDERED FOR MAN CTS Social inquiry report ordered for man The Senior Magistrate ordered a social inquiry report for a homeless man who admitted stealing $1,500 worth of computer equipment from a parked car.

Neville James Woods, 27, pleaded guilty to the offence that occurred on March 24, 1995.

Sgt. Donald Grant said Gary Dublin came home around midnight on March 24 and left his IBM tool repair kit inside the car.

When he returned sometime later it was gone. On March 30 Police officers were investigating another matter at the Salvation Army shelter and they found the IBM tools concealed under Woods' bed.

Some $500 worth of equipment was missing and Woods admitted that he discarded what he thought was useless.

A $500 multi metre tester is still missing. Woods said he threw away some wire and personal papers after he took the tools from the car.

Duty counsel Ms Patricia Harvey asked for a social inquiry report for Woods who was released from Westgate prison last September.

Senior Magistrate the Wor. Will Francis ordered the report and set the matter down for sentence on June 26, 1995. He released Woods on $800 bail.

MAN FINED $1,290 FOR TRAFFIC OFFENCES CTS Man fined $1,290 for traffic offences A 28-year-old Sandys Parish man was fined $1,290 in Magistrates' Court after he admitted a slew of traffic offences that included speeding and having no driver's licence or third party insurance.

Clark Riley, of Tribe Road, pleaded guilty to all the offences.

In the first incident that occurred on October 21, 1994, near Broome Street, Riley admitted riding an unlicensed motorcycle, without a licence or third party insurance.

The next series of offences took place on May 4, 1994 on the Middle Road in Paget. He was caught riding a motorcycle also without insurance.

On August 29, 1994 he was caught on Somerset Road in Sandys riding a motorcycle without a licence and on September 16, 1994 he was caught speeding on Middle Road, Southampton at 55 kph in an motorcar. At that time he did not have a driver's licence.

Magistrate the Wor. Cheryl Ann Mapp fined Riley $125 for each occasion he was caught without a driver's licence, $300 each for having no third party insurance, $190 for speeding at 55 kph and $125 for each offence involving an unlicensed vehicle.

TEEN PLEADS GUILTY TO CANNABIS CHARGE CTS Teen pleads guilty to cannabis charge A social inquiry report was ordered for a 17-year-old Warwick man who pleaded guilty to possessing cannabis.

Prosecuting Sgt. Kenrick James told Magistrates' Court that on January 27, Graham E. Sutherland, of Middle Road, was seen by Police with a group of school boys near the Spanish Point park.

"The officers heard one boy say `hide the dope' and they saw Sutherland, who appeared to be nervous, shove his right hand in his right trouser pocket,'' Sgt. James said.

He added that the Police searched Sutherland and found a cigarette packet which also contained a small manila envelope with plant material. Officers later found out the envelope contained .03 grams of cannabis.
