But Senior Magistrate the Wor. Will Francis ignored the pleas of John Brangman, fining him $400 and disqualified him from driving for 12 months.

Prosecuting, Sgt. Earl Kirby said that Brangman, 35, of Turkey Hill, was riding his auxiliary cycle on Mullett Bay Road, on September 18, when he hit a curb.

Police found him leaning against his damaged motorcycle. They said he showed signs that he had been drinking intoxicants.

Brangman told the officers that he was on his way to work at a restaurant in Hamilton Parish, where he is the janitor.

Police tested the level of alcohol in his blood and found it was more than twice the legal limit.

Brangman said: "I have been under medication for pneumonia for the past few months. When I had the accident on my motorcycle I had been taking my prescribed medication.'' He said that the medication contained alcohol and he thought he might have taken more than he should. He said he had definitely not been drinking alcohol because he was working double shifts and had not had time.

Mr. Francis said: "There was 200 milligrams of alcohol in your blood. More than twice the the limit in fact. That is the maximum capacity of the machine so it might have been more.''
