Commissioner Edward Dyer said an internal investigation had shown "no clear proof'' that Damion Wayne Smith was at the Anchorage Nightclub on North Shore Road on February 17.

When asked if Smith had been disciplined, Mr. Dyer said: "No, because we have no proof that he was out. We have not been contacted by Police. We made inquiries but have not received anything which has been helpful.

"He was never at the Co-Ed (Facility) and no, he was not on day release,'' Mr. Dyer added. "What happened was there was an allegation, and we received no proof. I don't have any more information.'' Police originally investigated whether Smith, 29, and jailed in 1996 for 12 years in the 1994 death of Reginald Chesterfield Wilson, was at a reggae session.

Initial reports had Smith sent back to the Westgate Correctional Facility as punishment, after having been moved to the Co-Ed in preparation for parole.
