Yearwood wins leave to appeal judgment

to appeal a Supreme Court decision not to grant him a summary judgment in his claim of $1.6 million against Brunswick Company Ltd.

The sum at the centre of the legal dispute is said to be the balance of money he lent the company, which owns and rents property along Front Street.

According to documents submitted to the Appeals Court, the sum was lent out over a period of time based on oral agreements between Mr. Yearwood and various directors of the company.

Earlier this year Supreme Court Mrs. Justice Wade-Miller turned down a request for summary judgment, which would mean the case will not go to a full trial, on the grounds that Brunswick had "a bona fide counter-claim arising broadly out of the same subject-matter of the action and connected with the grounds of the defence''.
