Accused killer Teiko Furbert told a Police officer he was prepared to "do the time'' since his alleged accomplice had "cracked under pressure''.

Sheldon Franks 32, of Dundonald Street, Pembroke is jointly charged with Furbert, 25, of Rocklands Estate, Warwick, in the murder of James Caines on July 6, 1996.

The Crown alleges that Franks and Furbert murdered Caines by shooting at him through a door into a house on 27 Curving Avenue around 9.30 p.m..

Det. Con. Terrance Maxwell said that he was in an interview room with Furbert who was on his way to a Magistrates' Court appearance.

With no prompting, he said the accused began to speak to him. At first Det.

Con. Maxwell said that Furbert confined his remarks to his court appearance and refused to say anything about the shooting.

Later on Det. Con. Maxwell said that Furbert asked him how much time in prison he could get.

"I told him he would have to be found guilty first but he said (the Police) will use Franks against him ... and he said he would do the time.'' Det. Con. Maxwell said he then asked Furbert why he would agree to go to prison if he had not committed any crime and the accused declined to comment under advice from his lawyer.

In response to questions from Frank's lawyer Mark Pettingill, Det. Con Maxwell said that Furbert also told him that he knew Franks would crack under pressure.

Meanwhile, Dr. James Johnson, a forensic pathologist at the King Edward VII Memorial hospital said that he conducted an autopsy on Caines' body around 10.30 p.m. on July 7, 1996.

He said that Caines' body had three recent injuries which were due to a bullet entry through the left side of his face.

Dr. Johnson said the bullet broke Caines' jaw and passed through his neck across his voice box.

The bullet passed out of his neck and lodged in his right shoulder.

Consequently, there was tremendous tissue damage in his neck which caused blood to flow into his lungs.

As his lungs filled with blood, he was less able to breathe and ended up suffocating.

The case continues this morning before Puisne Judge Richard Ground. Attorney General Elliott Mottley and Charlene Scott appear for the Crown. Archie Warner and Renee Foggo appear for Furbert.
