Appellant is bailed
Casemates' Prison on Friday.
Franklyn Smith, of Mount Hill, was given the sentence by Senior Magistrate the Wor. Will Francis on Wednesday after he pleaded guilty to a charge of unlawful wounding.
At the time Insp. Peter Duffy, prosecuting, said that the complainant was in Par-la-ville Park with friends when Smith picked up a three-foot long metal pipe and hit him in the head and across his leg on May 29.
As a result, the man required medical treatment.
Smith insisted he struck the man in self-defence after he threatened to hit him with a bottle.
The 31-year-old, who is married, said he had been sexually harassed by the man for two months.
After hearing his sentence, Smith told Mr. Francis he wanted to change his plea.
"There's no way I should have to do three months. It was in self-defence,'' he said.
Mr. Francis refused to accept the change in plea as he had already sentenced Smith. However, he told him he could appeal the sentence.
On Friday, Mr. Francis released Smith on $500 bail pending the outcome of his appeal to Supreme Court. He was ordered to report to Hamilton Police Station every Friday between 6 a.m.-6 p.m.
