The Court of Appeal said it would hear the formal appeal during its next session, probably in November.
The decision was made after lawyers argued over a Supreme Court order in May that reduced an injunction freezing Todd's assets to $3 million from $6 million.
Mr. Geoffrey Bell appeared for the bank which is seeking to have the original $6 million injunction restored. Mr. John Riihiluoma appeared for Todd.
Todd resigned from his bank job in February, 1991. He was suspended by the bank the previous December following the start of an internal investigation of bank lending practices.
