Magistrate Archibald Warner told Ellsworth Eugene Wilson he was free to go after the Crown offered no evidence that he stabbed Charles Edward Burgess at the Spinning Wheel Nightclub on May 31.

Crown counsel Charmaine Smith stood and told Mr. Warner: "The Crown is not offering any evidence with respect of this matter.'' Mr. Warner told Wilson: "The charges are dismissed and you are discharged.'' Wilson, of Mount Hill, has denied the charge since his first appearance in court on June 2. He was represented by lawyer Kim Wilson.

Initial Police reports said the incident occurred around 10.30 p.m. on May 31 after an argument between the two men. Mr. Burgess was in court yesterday.
