After hearing arguments from defence lawyer Mr. Archie Warner and Crown counsel Mr. Diarmuid Doorly in the absence of the jury, Puisne Judge the Hon.

Mrs. Justice Wade agreed to delay the case until Wednesday.

She gave Mr. Warner until 9.30 a.m. tomorrow to prepare further for the case, extending Ebbin's bail until that time.

"Unfortunately I have been persuaded to adjourn the matter because of pressing needs of counsel,'' Mrs. Justice Wade told jurors when they returned.

Ebbin has pleaded not guilty to importing cocaine between May 11 and May 20, 1990, with others not before the court, and to conspiring to import the drug between October, 1988 and May 17, 1990, also with others not before the court.

His re-trial was due to get underway last Monday but was adjourned for a week to give him more time to secure legal aid.

The case had originally been set down for re-trial on November 4, but was adjourned to November 12.

On that date it was further adjourned because Ebbin's first choice lawyer, English Queen's Counsel Mr. John Perry, was unavailable.

At the time, Mrs. Justice Wade said she would grant "one final adjournment''.

Ebbin was jailed for 20 years with Ted Ming, Dexter Edwin Dillas, and Colin Winfield Smith.

Ming and Smith were later freed by the Appeal Court, but re-trials were ordered for Dillas and Ebbin.
