Magistrate Edward King heard that a stay had been ordered on the murder case, pending the results of a hearing in Supreme Court later this week to quash the murder charge against Mundy.

Earlier this month Mundy's lawyer Mark Pettingill challenged the fresh charge of murder since his client was serving a five-year prison sentence for being an accessory to the murder of Canadian teen Rebecca Middleton in July 1996.

Mr. Pettingill, who has turned the case over to lawyer Saul Froomkin, will testify in the Supreme Court hearing to quash the murder charge against Mundy on Friday.

Meanwhile, Mr. King ordered that Mundy and Smith remain in custody and return to Magistrates' Court on February 9 for mention.

FIREMAN FACES TRIAL CTS FIR Fireman faces trial A fireman has pleaded not guilty to setting a false fire alarm and will face trial in June.

Gladwyn Grant denied making a call to Hamilton Fire Station on July 12, last year when he appeared in Magistrates' Court yesterday. He was released on $750 bail and ordered to return to court on June 16 for his trial.

When contacted yesterday Fire Service Spokesman Lt. Jon Thompson said Grant would remain on the job.

MEN ACCUSED OF ASSAULT CTS Men accused of assault Two Pembroke men were charged in Magistrates' Court with unlawfully assaulting another man.

Christopher Smith, 20, of Princess Estate Road, and Shawn Roberts, 18, of St.

John's Road, denied committing the offence against David Bull on November 30 in Pembroke.

Smith, who was represented by lawyer Richard Hector, and Roberts, who was unrepresented, elected summary trials in Magistrates' Court and were each released on $500 bail with a like surety. They are scheduled to return to court for trial on May 19.
