Impaired driver hit with five year ban

They asked him to move the car and he drove it around the block, then double parked again.

Insp. Duffy said when Dill was asked to get out of the car he was unsteady on his feet.

Police also noticed that his breath smelled of alcohol.

Dill has three reckonable convictions.

In December, 1990, he was fined $500 and banned from driving for 18 months for speeding at 69 kph.

And in January, 1991, he was fined and taken off the road for two earlier speeding offences.

"It's your first conviction for driving while impaired so I will charge you $350 or 35 days in prison in default,'' Magistrate the Wor. John Judge said.

"But because of those previous convictions I have to disqualify you from driving all motor vehicles for five years.'' Dill gasped and asked if there was some way he could appeal.

"Because this is ridiculous,'' he said.

"I'm not saying that you can't appeal,'' Mr. Judge told him. "But you will be wasting your time and money. My hands are bound by the law.

"I would have thought as this is your first conviction for driving while impaired that if you do not come back here, after two and a half years I'd say your chances of getting your licence back will be good.''
