face punishment for the alleged 1995 assault.

In 1996, Magistrate Cheryl-Ann Mapp found Shannon Tucker of Broken Hill, Smith's Parish guilty of using threatening words, possessing offensive weapons, and causing grievous bodily harm to former boxer Frederick Thomas.

The then 20-year-old allegedy beat and threw a bottle at Thomas in an altercation outside the Harrington Workmen's Club.

But last year Puisne Judge Vincent Meerabux overturned the verdict and ruled Ms Mapp's decision was "simply not good enough''.

However, the Attorney General's Chambers have since taken the matter to the Court of Appeals.

Tucker -- who was never sentenced for the offences because of the immediate appeal launch -- was unrepresented last week.

But he said he had sought legal aid and believed Mark Pettingill would be present.

And he maintained he did not strike the first blow in the 1995 fight.

A court decision is expected next week.
