But the 41-year-old was told by Acting Magistrate Wilhelm Bourne: "We wouldn't summon someone from the Senate Chamber!'' Mr. Bourne adjourned the trial of William Clemons because he was already in the middle of another hearing.

Clemons, of Cherry Hill Park, Paget, had wanted Mr. Bourne to order Government Senator Michael Scott, his defence counsel, to appear for the hearing.

But the defendant was told to reappear in court on January 6 for a new trial date to be set.

He is charged with operating a telecommunications system without a licence, causing harmful interference and using threatening behaviour. Crown Counsel Larry Mussenden, prosecuting, said: "Mr. Scott sent a fax saying he would be in the Senate so he asked for an adjournment.'' Mr. Bourne said the case had to be put off anyway -- because he was already in the middle of another trial.

He told Clemons: "Make sure you are ready for your defence when the time comes.

"If your lawyer isn't here, we will proceed. We cannot go looking for lawyers, you see?''
