imported some $4,000 worth of heroin into Bermuda for his own use or to sell on the street.

Davon Tavis Cann of Somerset pleaded guilty to importing 12.8 milligrammes of the drug last August 11 via commercial airliner.

Customs officers found it concealed in a tube of hair gel during a search of his luggage Cann told Police and Customs officers at the Civil Air Terminal he was not a heroin addict, Crown counsel Mr. Brian Calhoun said.

But Cann's lawyer Mr. Archie Warner said his client had not stated he was going to sell the drug either.

"There is no evidence the drug was for anything other than his personal use,'' Mr. Warner said.

But Mr. Calhoun disagreed, repeating that Cann had told Police he was not a heroin user. If he was now saying something different, there should be a trial, he said.

Mr. Calhoun added that even if the heroin was for Cann's own use, there was always the chance it would fall into other hands.

Mr. Warner suggested a social inquiry report would be of benefit, though he planned on calling someone from Addiction Services to give evidence that Cann was, in fact, a heroin addict.

Mr. Warner noted denial was often a feature of drug addiction. He added Cann had told him he bought the drug for $1,000.

Puisne Judge the Hon. Mr. Justice Ward, noting Mr. Calhoun had said Cann only earned $300 a week as an upholsterer, said it was "crazy'' he would spend $1,000 on drugs for pleasure.

Mr. Warner said Cann was addicted and could not help himself.

Mr. Ward ordered a social inquiry report and adjourned the case to May 14 for sentencing.
