Senior Magistrate yesterday in plea court.

Mervyn Smith, 42, of Bob's Valley Lane, Sandys Parish pleaded not guilty to supplying heroin on June 6 on Broome Street in Sandys. He also claimed the legal aid committee viewed videotaped evidence against him and violated his rights.

Smith was arrested along with 15 other men during the joint undercover drug sting and is set to go on trial for the matter on September 30.

Yesterday Smith stood and asked Senior Magistrate Will Francis what he could do to get the Government Analyst involved in his case, to appear for his Long Form Preliminary Inquiry set for Thursday.

"My rights are being violated,'' Smith said. "I've been denied legal aid, because the legal aid committee has viewed everyone's Cleansweep movie.'' Mr. Francis answered Smith by saying: "Every time you come to court you waste my time.'' Police prosecutor Sgt. Phil Taylor said Philip Martin was involved in a two-car accident on August 18 at 8.50 p.m. on Crow Lane, Pembroke. While talking to Martin the officers noticed his breath smelled of alcohol and his eyes were glazed.

Martin admitted that he had been drinking.

But when he was taken to Hamilton Police Station he refused to take the alco-analyser test.

Yesterday, Martin told Senior Magistrate Will Francis he was a supervisor at First Choice Construction and that he needed some form of transportation in order to get around.

Mr. Francis took Martin's job into account and banned him from driving private cars only for two years.

He also fined Martin $800 for the offence.

MOUCHETTE TO BE SENTENCED NEXT MONTH CTS Mouchette to be sentenced next month A 40-year-old Sandys man will shortly learn his fate after pleading guilty to importing cannabis.

George Mouchette, of Rushy Lane, will be sentenced on October 1.

Mouchette's lawyer, Elizabeth Christopher, last week made an unsuccessful application to delay matters until a social inquiry report could be prepared.

But Chief Justice Austin Ward said he did not need a report to sentence Mouchette who was remanded in custody.
