claimed that HIV infection had caused him to lose his memory.

Anthony Bartley of the Railway Trail in Sandys told Senior Magistrate Archibald Warner: "I have a health problem which affects my memory and things. It's HIV.'' Bartley said he could not remember that he was to appear in court and when read charges of having no vehicle licence and no third party insurance said he had no recollection of the incident.

Openly admitting that he could not afford to pay any fines, Bartley suggested that Mr. Warner work out a creative penalty for him in order that he avoid prison.

"If you could hook up some work for me to do,'' he suggested, "cause I don't like the predicament I'm in. I want to be a productive member of society.

"You need to hook up another system for people who cannot afford to pay these fines,'' he continued.

"If the courts need painting, I can do that, or some carpentry work, I can do that, but you can't send me to prison. I can't even hardly walk. I can't go up steps,'' he said.

"I'm trying to work out something else just because I ain't got no money.'' Mr. Warner sentenced Bartley to 120 days in prison and told him that he hoped he would be afforded the medical care he needs.
