Perry Kuhn Simons, 25, of Long Bay Lane, left his victim lying in a pool of blood after attacking him with a baseball bat at Woody's Drive Inn on September 2 last year.

The 20-year-old man was rushed to the Intensive Care Unit of the King Edward VII Memorial Hospital after being found unconscious in the parking lot of the Boaz Island restaurant.

Simons pleaded not guilty to grievous bodily harm with intent to maim, disfigure, or disable. Puisne Judge Norma Wade Miller ordered the charge be left on file after the Crown offered no evidence.

But he admitted the lesser charge of simple grievous bodily harm.

And Mrs. Justice Wade Miller granted a request from Simons' lawyer Larry Mussenden for a social inquiry report and psychological test, but she refused bail.

She added: "This is not a matter in which one would anticipate a non-custodial sentence.'' Simons will appear for mention on June 1 to get a sentencing date.
