in custody, after the young man ignored his community service sentence.

Paco Talieph Fubler, of St. David's, was also charged with assaulting a Police officer on March 29, violently resisting arrest, escaping lawful custody and intentionally obstructing a Police officer while he was exercising his powers under the Misuse of Drugs Act.

Fubler pleaded guilty to the escaping lawful custody charge only.

He also admitted stealing a bottle of Scotch whisky worth $30 from the MarketPlace on December 16.

The young father was convicted last year of indecently assaulting a young woman.

He received a a sentence of 100 hours of community service.

Fubler yesterday said he had not done any because he was moving from place to place. But he said he was now stable.

But probation officer Mr. Norvell Furbert said he believed community service was no longer a suitable sentence for Fubler.

He said Fubler, who frequently passed by the Probation Services offices, only showed up for one appointment -- and then he was late.

Duty counsel Mr. Justin Williams said while he did not expect probation officers to chase after people, they could have approached Fubler if they saw him pass by.

Mr. Furbert said in December he stopped Fubler once and asked him to come and see him but that had not happened.

"We've bent over backwards to try to assist you and for months you have done nothing,'' Mr. Francis told Fubler. Mr. Williams questioned whether sending Fubler to prison would be productive.

"Mr. Fubler has obviously been delinquent,'' Mr. Williams said. "But he's asking for one last opportunity. If he does not respond then he only has himself to blame.'' Fubler was fined $50 for stealing the whisky and remanded in custody until April 13 when he will be sentenced on the escaping custody charge. He will be tried on the other offences on June 1.
