Man pleads guilty to assault

Frank Francis Eugene Smith, 39, of Mount Hill, pleaded guilty to assaulting a Police officer on July 27.

appeared in Magistarates' Court yesterday.

Frank Francis Eugene Smith, 39, of Mount Hill, pleaded guilty to assaulting a Police officer on July 27.

Crown counsel Oonagh Goodred told the court that officers were issued a warrant to arrest Smith for failing to pay $450 in outstanding fines.

Senior Magistrate Archibald Warner heard that about 5.50 p.m., patrolling officers located Smith at Par-la-Ville Park, where he was informed of the warrant.

Smith denied that he owed money.

When officers proceeded to arrest Smith, he replied: "Don't put your hands on me!'' He then pushed away the arresting officers, resulting in a struggle.

The court heard how one of the officers grabbed Smith around his chest and torso, eventually allowing the other officer to put the handcuffs on him.

He was taken to Hamilton Police Station where he was cautioned.

Smith told Mr. Warner: "First of all, I didn't put my hands on anyone. Second of all I think that I was the one that was assaulted.'' Mr. Warner fined Smith $300 for the offence.
