Crown counsel Nita Grewal told the court that Kevin Raynor, of Raynor's Drive, was spotted by two fish wardens in the Great Sound, east of Riddell's Bay Beacon.

She said Raynor was seen diving under the water numerous times beside a small white dinghy.

Ms Grewal also noted that he was wearing a mask and snorkel and had a spear and onion sack with two and a half pints of mussels, two hogfish and a turret fish in it.

Duty counsel Duncan Hall explained that Raynor had recently lost his job and had been spearfishing for food and money.

Senior Magistrate Will Francis ordered Raynor to pay a $350 fine and told him, "Fish within the regulations, that is what you have to do''.
