Asked if he would pursue a civil lawsuit against Mr. Duncan, Mr. Hayward said "possibly'', adding he planned to take advice.

Last month, Mr. Duncan was charged with unlawfully publishing a defamatory document against Mr. Hayward.

The letter, consisting of two brief sentences, was not read out in Magistrates' Court yesterday.

Mr. Duncan, 51, who appeared before Senior Magistrate Will Francis, did not enter a plea but acknowledged the facts of the charge as entered by Crown counsel Leighton Rochester and was bound over for one year.

If Mr. Duncan is convicted of another offence in the next year, the charge could be revisited.

Mr. Hayward alleges that a letter sent to Anglican Church Archdeacon Arnold Hollis last October resulted in him failing to become Pembroke Parish rector and possibly Paget Parish rector.

"The matter is certainly not over by any means,'' he said.

Mr. Francis said the defendant had no prior convictions, that he was previously of impeccable character and "that this was out of character is clear''.

Saul Froomkin, representing Mr. Duncan, said Mr. Duncan is under medical care for depression.

Mr. Froomkin also provided the court with 50 letters of reference in support of Mr. Duncan.

"This indicates the friendship and support the accused has the community,'' Mr. Froomkin said. "He lost objectivity. He did something wrong. He seeks forgiveness, not only from those involved but also from his God.''
