Sex case accused tell of `passionate kissing'

Shore beach told Police she was a willing partner and had kissed him passionately, a Supreme Court jury heard yesterday.

The 42-year-old Sandys Parish resident has denied charges of having carnal knowledge of the woman against the order of nature, attempting to rape her and indecently assaulting her.

The court heard the alleged offences occurred on the afternoon of December 12, 1990 on a Warwick beach.

The jury spent yesterday afternoon on a site visit to the beach, which can be reached by following a tree-lined pathway and then descending a fairly steep cliff.

Det. Sgt. Steven Lightbourne, who interviewed the defendant, said the man told him he met the woman while she was walking in Somerset.

He said she agreed to have lunch with him at the Paraquet restaurant and go to the beach afterwards.

After chatting for a while on the secluded beach the defendant said he "gently embraced'' the woman and she consented to having sexual intercourse, taking her own underwear off, Det. Sgt. Lightbourne said.

The defendant told Police: "She put more tongue on me than I did on her.'' He said she insisted on catching the bus home afterwards despite his repeated offer to give her a lift.

Dr. Keith Cunningham testified that a physical examination of the woman a day after the alleged attack showed she sustained no physical injuries except some tenderness to her breasts and shoulders which was consistent with hard grabbing or a "grip of passion.'' And he said an examination of her anus was consistent with her recently having anal sex.

The woman admitted on the witness stand on Monday that she agreed to go to lunch and to the beach with the man whom she had just met.

The woman told the seven-woman five-man jury the defendant began kissing her while they were sitting on some rocks and she tried to fight him off.

Despite her cries of protest, the woman alleged he pulled off her underwear, bent her over and while holding her tightly, had anal sex with her for about 15 minutes.

She said she screamed loudly the whole time, but no one heard her.

The American woman, who lives in Mississippi, said she met the defendant while walking to a shoe repair store in Somerset.

She said he invited her to lunch after a brief conversation about her in-laws.

The defendant was arrested a day after the alleged sex attack following a complaint to Police by the woman's brother-in-law. The court heard the woman had confided to her brother-in-law she was raped and asked his advice.

On Monday Mr. Perinchief suggested to her: "The reason you brought this complaint is because the sex you had with (the defendant) was totally against your religion and you wanted to make peace with your conscience.'' The accused is expected to testify today before Puisne Judge the Hon. Mrs.

Justice Wade.
