bid to protect his home from hurricanes will be back before the courts next month.

Peter Prescesky of Saucos' Hill and lawyer for Island Construction, John Cooper, appeared in Magistrates' Court yesterday regarding Prescesky's attempt last summer to build a seawall to protect his front yard.

The Environment Ministry at that time ordered a stop to the construction of a three-deck concrete retaining wall after allegations that Prescesky stole natural boulders from his neighbours and was destroying their foreshore.

Prescesky -- who had obtained a Planning permit to restore his shoreline after it was damaged by Hurricane Felix -- had failed to notify inspectors that the work was in progress.

Because of that omission, regular inspections of the project had not been carried out.

The controversy came to a head just before the Labour Day weekend when neighbours noticed heavy equipment operating along the waterfront and residents of the Pokiok Road area began complaining about damage to their shoreline.

Yesterday Senior Magistrate Will Francis accepted Crown counsel Philip Storr's request for an adjournment of the matter.

The case will continue on May 29.
