Supreme Court yesterday heard that Archie Warner -- defence lawyer for murder accused Justis Smith -- had suffered a heart attack.

And extra time is also needed to make sure witnesses from overseas are able to attend.

The news came as Smith, who has been remanded in custody since his arrest more than a year ago, made another appearance at the arraignments session.

Smith, 18, is charged with the premeditated murder of Rebecca Middleton, 17, on holiday on the Island from Belleville, Ontario.

It is alleged Smith, of Deepdale Road, Pembroke, murdered the girl on Ferry Reach, St. George's in July last year. The case was deferred until the next arraignments session on November 3.

And Damon Deroza, 20, of Warwick -- accused of murdering his five-year-old daughter Lynae Brown -- had a trial date set for on or after October 13.

Deroza was remanded in custody for the trial date, when the question of whether he is sane and fit to plead is likely to be raised.

Randolph Granville Lightbourne admitted causing the death of Colin Francis by reckless or dangerous driving on October 16 last year.

Lightbourne further admitted conspiring to defeat the ends of justice with two others by making false statements to Police.

Calvin Leroy Simmons admitted a committing a serious sexual assault on June 23. Another charge of burglary was allowed to lie on file.

Defence lawyer Mark Pettingill asked for a psychiatric report before sentencing. Chief Justice Austin Wood remanded Simmons in custody for mention on November 3.

Charles Maxwell Warren -- who is charged with three others -- pleaded not guilty to wounding with intent to cause grievous bodily harm to Roger Lightboure on October 30 last year.

He also pleaded not guilty to a charge of having an offensive weapon, a knife, in a public place on the same date.

A total of three people appeared at the arraignments session charged with drugs offences.

Trevor Donovan Simons denied five charges of supplying cocaine between 15 April and May 2. He was remanded in custody until November 3.

Jerry Gary Fubler denied three drugs charges -- two of supply and one of possession with intent to supply -- involving cannabis and cocaine.

The offences were allegedly committed between May 12 and June 6 this year.

Fubler was remanded in custody for mention on November 3.

And Vicki Lynn Maiato, was charged with possession of cannabis on February 16.

She pleaded not guilty and was released on $500 bail for mention at the next arraignments session.
