Ian Jason Simmons, who was shot during an altercation in the Spinning Wheel nightclub told the Supreme Court yesterday that everything he told Police about the shooting came from his mother.

"I don't remember what happened at Spinning Wheel,'' he said, adding he did not know if his statement was true or not.

Earlier this week the court heard that Simmons, who is also known as DeSilva, was shot four times and was in intensive care in hospital for ten days.

Another bullet hit Jermaine Lovell in the hand.

Charles Roger Richardson, 24, of Harrington Sound Road, Smith's Parish, denies attempted murder, wounding with intent, unlawful wounding, using a firearm and possession of a prohibited weapon.

Simmons told the court he remembered everything leading up to the shooting including the month before when he said Richardson told him to stay away from him.

And on October 29 last year Simmons said Richardson was angry with him and he knew the reason why.

"While at Spinning Wheel at the top bar I saw Charles pointing a gun at me from across the bar. I was mad that he was pointing a gun at me so I threw an ashtray or something at him and it broke something. The bartender jumped over the bar and grabbed me and tried to rustle me to the ground but some guys pulled him off and I managed to get away from him,'' Simmons told Police.

Defence lawyer Mr. Mark Pettingill asked Simmons, "Wasn't it quite brave of you to throw an ashtray at a man pointing a gun at you?''m He replied, "I wasn't worried about that.'' Simmons added, "I walked towards Charles at the end of the bar and as I moved towards him he moved towards me. I wanted to confront him, I didn't know if the gun had real bullets or blanks but I wanted to hit him. "I remember that I was eight feet away and Charles pointed the gun at me and was shooting me and then I blanked out. I do not remember how many times I was shot and I did not see anyone else grab the gun.'' On Monday the court heard that Richardson was arrested by the Police Emergency Response Team at his home the next day. Officers searched Richardson's home and arrested him on suspicion of attempted murder.

Richardson told Police that a brawl started at the club and people were grabbing him from all directions.

"I felt the firearm being pulled away from me. I felt if they got it from me they would kill me with it. I felt the gun being drawn from my waistband. It was not me who was pulling it and I was afraid if they got it away they would kill me,'' he told the Police.

"The gun was out and we were struggling, but I did not have control of the gun. The gun went off but I cannot say how many shots were fired.'' He said he went outside and only then discovered what had happened and ran home to his grandmother's where his mother later picked him up.
