yesterday in Magistrates' Court after pleading guilty to driving while impaired.

Alfred M. Nesbitt, 59, of St. George's, was seen trying to restart his car after colliding with a stone wall on Suffering Lane in St. George's on June 8.

Police prosecutor Sgt. Anthony Mouchette said Police stopped at the scene of the accident at 3.30 a.m. that day and noticed that Nesbitt's breath smelled of alcohol, his eyes were glazed, and his speech was slurred.

He was arrested and taken to Hamilton Police Station where he agreed to take the alco-analyser test and failed.

Nesbitt, who also pleaded guilty to excessive driving of a taxi, was said to have been driving his cab since 5 a.m. on June 7, almost for 24 hours.

Senior Magistrate Will Francis rejected Nesbitt's plea to be allowed to keep his licence since the taxi business was his only means of income.

"Let me say this, I don't think I can do that at all,'' Mr. Francis said.

"This is a serious matter for a taxi driver or anyone in charge of a pubic service vehicle.'' Mr. Francis banned Nesbitt from driving for 12 months and fined him $500 for the offence.
