That was the decision yesterday from the Court of Appeal, after hearing accusations that Mr. Todd stole millions of dollars from Bank of Bermuda customers.

The bank had asked the court to freeze $6 million of his assets, in case he moved it overseas or hid it.

Meanwhile, Mr. Todd asked for his assets to be completely unfrozen.

The three Appeal Court judges dismissed both requests, meaning a current court order freezing $3 million still stands.

Mr. Todd, who resigned as personal banking manager in February, 1991, faces accusations that he siphoned off huge sums of money using phony loan agreements.

The Court of Appeal will release the reasons for its decision later.
