Kyle Christopher Wright, 37, of Ponte Vedra Beach, Florida was waiting in line in the customs hall of Bermuda International Airport when he was noticed by Police officers who thought he was acting suspiciously.

The court heard how Wright appeared nervous and left the line, went back into the baggage claim area and threw a pack of Marlboro Lights cigarettes into the trash.

An officer retrieved the cigarette pack and found it contained several home made cigarettes and approached Wright and placed him under arrest.

He told officers: "I threw it away because I thought I was going to be searched. I am only a recreational user.'' The weight of the cannabis was later established to be 2.03 grams. Wright apologised to the court for his actions.
