Breaking News: Govt - CableVision wrong

A decision by CableVision to stop airing channels 7 and 9 is wrong, the Department of Telecommunications said this afternoon. In a statement, the Department said it was assuring the public that CableVision’s notice to stop airing the two Bermuda Broadasting Company channels from December 11 was “incorrect”.A Department spokesperson said: “Section 21(1) (i) of The Telecommunications Act 1986 clearly states, it is the duty of every carrier to maintain existing services unless permitted by the Telecommunications Commission to discontinue such services.

CableVision does not have to carry channels 7 and 9, Chief Justice Richard Ground ruled this morning.

In a Supreme Court judgment, Mr. Justice Ground said Bermuda’s legislations allow CableVision to choose not to carry ZBM in certain circumstances.

It follows a judicial review after the Department of Telecommunications said CableVision had to continue carrying Bermuda Broadcasting Corporation programming, which it had done for many years.
