Inquiry doesn’t require my permission, says Governor

Governor Sir Richard Gozney said last night that he did not believe Glenn Blakeney’s Commission of Inquiry into cricket and football fell under the powers of the Commissions of Inquiry Act of 1935 and so therefore did not need his approval.Under section one of the Act the only person allowed to convene a Commission of Inquiry and appoint commissioners to its panel is the Governor.Minister Blakeney’s official statement regarding his commission, which he launched last Thursday, includes terms of reference that covers the establishment of ‘an independent Commission of Inquiry into Football and Cricket’.The Minister also appointed seven commissioners, something that would fall outside of his authority under the terms of the 1935 Act.However, Sir Richard said that he had been led to believe that Blakeney’s commission was not intended to be a full blown Commission of Inquiry, which can compel people to appear to give evidence.While section nine, paragraph one of the 1935 Act says ‘commissioners acting under this Act shall have the powers of the Supreme Court to summon witnesses, and to call for the production of books, plans and documents and to examine witnesses and parties concerned on oath’, the terms of reference for the newly-launched inquiry differ in one crucial aspect.The ‘Access and Confidentiality’ section of the inquiry has no scope enabling it to force people to co-operate and only goes as far as saying that the commission can request ‘access to pertinent reports’ and be ‘afforded the opportunity to interview persons’.“My understanding is that the Commission of Inquiry launched into football and cricket by the Hon Minister for Sports is not intended to be a Commission of Inquiry under the Commissions of Inquiry Act of 1935,” Sir Richard said yesterday.“It does not therefore require the Governor’s approval. I do not imply indifference: like many in Bermuda, and someone who just this afternoon was watching Bermuda play the MCC, I shall be watching for the outcome with interest.”
