Painter prepared for court battle for his art's sake

Police are non-committal about what action, if any, will be taken against Manuel Palacio if he displays his Body and Soul painting again this week.

The painting was confiscated at last week's Harbour Nights on Front Street because Police received a complaint that it was obscene.

Mr. Palacio refused to take it down when asked to do so by Police officers because he said that that would validate the obscenity claim.

Mr. Palacio vowed to display the work at the next Harbour Nights in St. George's and Hamilton. Contacted yesterday afternoon a Police spokesman said : "Our response will be guided by any complaints we receive. It's also going to be guided by any advice that is given."

The spokesman would not elaborate.

Last week's action by the Police has been questioned by the Chamber of Commerce and PLP MP Wayne Perinchief.

Police warned then that while Mr. Palacio was not charged last week, that may change if he insists on displaying the painting in public.

Yesterday Mr. Palacio said in the end a magistrate or judge may have to decide whether he was violating the Obscene Publications Act.
