Judge gives housebreaker a suspended sentence

A thief caught breaking into the same Devonshire home twice in the same month was given his ?last chance? in Supreme Court on Friday ? a two-year prison sentence suspended for three years.

Shannon D. Somersall, 39, of Longridge Pass, Devonshire, was convicted of breaking into Dwight Furbert?s Devonshire home between April 15, 2005 and May 7, 2005.

The first time, Somersall stole around $100 worth of coins, Crown counsel Anthony Blackman said. Then on May 17, 2005, he stole $15 in coins and a $60 pair of ?Brazilia? sneakers.

Puisne Judge Geoffrey Bell said there were two matters to consider in this case ? the public needed to be protected and Somersall needed drug treatment.

?I will make very clear to him that this represents the last chance he has,? Mr. Justice Bell said. Defence lawyer Peter Farge said the Salvation Army?s Harbour Light drug treatment programme had an opening for Somersall on May 15. However, his client was due to be released from prison for an unrelated civil matter on May 13.

But Mr. Justice Bell said he could remand Somersall in custody until May 15 when Harbour Light counsellors were able to receive him. Mr. Justice Bell also imposed a 10 p.m. to 6 a.m. curfew on Somersall upon completing Harbour Light ? expected to run anywhere from four to six months.

?You will not be able to work night time for the six months following your release,? the judge told Somersall.

Mr. Blackman said the Crown had wanted ?another type of sentencing? but conceded to the Judge?s decision. ?My concern has been the security aspect. How secure is this place to prevent Somersall to go outside and indulge in these activities?? Mr. Blackman asked.

But Mr. Justice Bell said he was also sentencing Somersall to a three-year probation order, which meant if he committed any more offences during that time he would be brought back to Supreme Court and be subject to two years in prison.

In addition to abstaining from drugs and alcohol during his probation, other conditions Somersall must comply with are: appearing in court when ordered, telling a Probation Officer about changes to his address or employment, regular meetings with a probation officer. Somersall cannot leave the Island without written permission of the court.
