officers and breaking and entering a Hamilton business.

Stephen Pitt, of Alexandria Road, pleaded not guilty to a total of five charges when he appeared in Magistrates' Court.

They are alleged to have occurred on April 19 when Pitt was on $1,500 court bail for other matters including possession of "breaking equipment'' and an offensive weapon -- namely a putty knife.

It is alleged that Pitt broke into Tools and Equipment Unlimited on North Street and stole three one-gallon bottles of Armour All cleaning fluid worth $129 while the other offences occurred later.

Police prosecutor Sgt. Phil Taylor told the court Pitt allegedly committed the offences while on bail for other matters. He said he was objecting to bail on these grounds.

Pitt's lawyer, Victoria Pearman, said her client had been held in custody since Wednesday morning and added that Pitt had pleaded not guilty to the other offences he was facing.

Therefore he was entitled to be treated as not guilty by the court as none of the allegations he was facing had been proved, said Ms Pearman.

Senior Magistrate Will Francis released the man on $1,000 bail with a like surety and ordered him to be back in court for mention on April 21.

THREE-YEAR BAN FOR PAGET DRIVER CTS Three-year ban for Paget driver A 51-year-old Paget man was disqualified from driving for three years and fined $1,100 last week in Magistrates' Court after pleading guilty to one count of speeding and his third impaired driving offence in two years.

Julian Shiell, of 31 Dudley Hill, was clocked speeding at 68 kilometres per hour in a white Suzuki van on February 17.

When Police stopped him, officers noticed Shiell stumble and observed his eyes were glazed and his breath smelled of alcohol.

Shiell was taken to Hamilton Police station where an alco-analyser test revealed a breath sample of 130 milligrams of alcohol in 100 millilitres of blood. The legal limit is 80 milligrams.

Senior Magistrate Will Francis was told this was Shiell's third impaired driving offence in two years. Shiell asked the Court to allow him some form of transport as he needed it due to business interests.

"There's no question with a record like yours that I'm going to give you any chances,'' replied Mr. Francis. He fined Shiell $800 for impaired driving and $300 for the speeding. He further suspended Shiell from driving for 18 months for speeding, and three years for impaired driving. The suspensions are to run concurrently.

SOCIAL INQUIRY REPORT ORDERED CTS Social inquiry report ordered A social inquiry report has been ordered for a 25-year-old Pembroke man who admitted stealing over $1,100 worth of electronics from a home he was helping to renovate.

Senior Magistrate Will Francis was told Antoine Norman Smith, of South Terrace Road, Pembroke was part of crew contracted by a Watch Hill Road, Warwick homeowner to carry out renovations on the property.

Prosector Sgt. Phil Taylor told the Court that while the family had temporarily moved out of the house, they had stored their valuables in two locked bedrooms with the condition that no-one should enter them.

While work was in progress, the homeowner carried out a few periodic inspections and noted the bedroom doors had been unlocked; it wasn't until January 5 when the family moved back, that they noticed various electronics had gone missing, including a telephone answering machine, television, and stereo components.

Investigators subsequently found the television and stereo components at Smith's girlfriend's apartment on South Terrace Road. Smith eventually led Police to the rest of the booty and admitted the thefts under questioning, said Sgt. Taylor.

Smith told Police he had intended on selling the items to earn extra money for Christmas.

Duty Counsel Richard Horseman pointed out Smith had expressed remorse for his actions and had cooperated fully with Police. It was also Smith's first offence, he told Mr. Francis.

Mr. Francis concurred and ordered Smith released on $500 bail, to return at a later date.

JAIL SENTENCE APPEAL DISMISSED CTS Jail sentence appeal dismissed A 40-year-old man who sexually exploited his 14-year-old nephew had his appeal against the three year jail sentence he received dismissed by a Supreme Court judge recently.

Puisne Judge Vincent Meerabux ruled that Senior Magistrate Will Francis' sentencing of the man, who cannot be named for legal reasons, appeared heavy but was appropriate due to aggravating factors.

In a written judgment, Mr. Justice Meerabux said: "It appears that the appellant on numerous occasions over a period of time deliberately set out to corrupt his nephew who was 14-years-old.''
